    O ministro Gilmar Mendes, do Supremo Tribunal Federal (STF), decidiu nesta quarta-feira (28) suspender decisões judiciais que obrigaram o governo federal a comprar o medicamento Elevidys. Usado para tratamento de Distrofia Muscular de Duchenne (DMD), o remédio é importado e custa cerca de R$ 17 milhões.

    A decisão do ministro não vale para as decisões que beneficiaram crianças que vão completar 7 anos de idade nos próximos seis meses. A idade é o marco para o início do tratamento.

    Nesses casos, o pagamento do remédio pelo governo ficará condicionado à realização de exames genéticos para atestar a elegibilidade para o tratamento.

    A decisão do ministro foi motivada por um recurso protocolado pelo governo federal.

    Segundo Mendes, a concessão desordenada de decisões judiciais sem negociação prévia dos custos pode ocasionar um colapso financeiro no Sistema Único de Saúde (SUS). As decisões somam aproximadamente R$ 1 bilhão.

    O ministro defendeu métodos alternativos para aquisição de medicamentos de doenças raras.

    “Por meio deles, as partes negociam preços justos para o produto e, ainda, dividem os riscos relacionados à sua eficácia, condicionando o pagamento do preço total à apresentação de benefícios para o paciente”, argumentou o ministro.

    Além de suspender as decisões, Mendes determinou que o caso seja discutido nas audiências de conciliação que estão em andamento no Supremo sobre a questão.

    Na semana passada, representantes do Ministério da Saúde, da Agência Nacional de Vigilância Sanitária (Anvisa) e a farmacêutica Roche, responsável pela produção do medicamento, se reuniram para tratar do fornecimento do remédio.

    Foram tratadas questões sobre o procedimento de importação, possibilidade de compra direta pelo Ministério da Saúde e a necessidade de realização de exames de compatibilidade genética antes da infusão da medicação.

    A próxima reunião está prevista para 30 de setembro.

    Equipe econômica detalha medidas para cortar R$ 26 bi em gastos

    Dois meses após o ministro da Fazenda, Fernando Haddad, anunciar o corte de cerca de R$ 26 bilhões de gastos no Orçamento de 2025, a equipe econômica anunciou, nesta quarta-feira (28), em Brasília, o detalhamento das medidas de revisão de despesas obrigatórias. O principal foco está na melhoria da gestão e na redução de fraudes.

    Dos R$ 26 bilhões previstos, o plano efetivamente contempla R$ 19,9 bilhões em revisão de cadastros. Os R$ 6,1 bilhões restantes virão do que o Ministério do Planejamento chamou de “realocações” internas de verbas nos ministérios que farão gastos com o Bolsa Família, com pessoal e com o Programa de Garantia da Atividade Agropecuária (Proagro) voltarem ao nível de 2023. A diminuição dos gastos obrigatórios seria liberada para gastos discricionários (não obrigatórios).

    Dos R$ 19,9 bilhões prometidos na revisão, a maior parte – R$ 7,3 bilhões – virá de revisão de gastos do Instituto Nacional do Seguro Social (INSS). Deste total, R$ 6,2 bilhões sairão do pente-fino no Atestmed, sistema do INSS de concessão de auxílio-doença por meio de atestados médicos digitais, sem perícia. Mais R$ 1,1 bilhão virá de medidas cautelares e administrativas.

    Em segundo lugar, está a revisão no Benefício de Prestação Continuada (BPC), cujo crescimento das despesas foi um dos fatores que fez o governo bloquear R$ 11,2 bilhões de gastos discricionários em julho.

    O governo pretende economizar, no próximo ano, R$ 6,4 bilhões com o benefício: R$ 4,3 bilhões por meio da atualização do Cadastro Único para Programas Sociais do Governo Federal (CadÚnico) e R$ 2,1 bilhões através da reavaliação de perícias.

    Em seguida, vêm R$ 3,2 bilhões da reavaliação na concessão de auxílios por incapacidade do INSS, que inclui tanto o auxílio-doença como a aposentadoria por invalidez. Completam a lista R$ 1,9 bilhão de mudanças no Proagro e o pente-fino de R$ 1,1 bilhão no seguro-defeso.

    Em entrevista coletiva para anunciar o plano de revisão de gastos, o secretário de Monitoramento e Avaliação de Políticas Públicas e Assuntos Econômicos do Ministério do Planejamento, Sergio Firpo, admitiu incertezas nos números. Ele, no entanto, disse que a economia pode ser maior porque as projeções são conservadoras.

    “Há uma incerteza associada. A gente tem estimativas que são as melhores que conseguimos com as informações existentes. Existe margem de erro, existe. A gente tem sido conservador, mas é obvio que há incerteza”, declarou Firpo.

    Segundo o secretário-executivo do Ministério da Fazenda, Dario Durigan, as medidas anunciadas hoje são apenas um “primeiro passo”, e o governo pode tomar ações adicionais.

    “O que estamos mostrando agora é onde vão incidir os R$ 26 bilhões. Claro que outras coisas precisam ser feitas e serão feitas. O trabalho de revisão de gastos é feito a todo tempo”, analisou.

    Economia em 2024

    Em relação às medidas de revisão de gastos para 2024, Durigan não deu detalhes. Disse apenas que o “ritmo está muito positivo e até acima do esperado”. Em julho, os Ministérios da Fazenda e do Planejamento tinham anunciado que o governo pretendia economizar R$ 10 bilhões neste ano com a revisão de gastos.

    Firpo, no entanto, relatou alguns números parciais. Até junho, a revisão de gastos com o Atestmed gerou economia de R$ 2 bilhões de um total de R$ 5,6 bilhões previstos para este ano.

    A revisão de benefícios por incapacidade reduziu os gastos do INSS em R$ 1,3 bilhão em 2024, com o cancelamento de 133 mil benefícios de um total de 258 mil reavaliados.
